Terms of Service

This is a legally binding agreement between you (“you” or “User”) and Miloji Live (“we,” “us,” or “our”) governing your access to and use of the Miloji Live mobile application, and all related features, content, and services (collectively, the “Service”). By accessing, downloading, or using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by the terms and conditions set forth in this agreement.

If you do not agree to these terms in their entirety, or if you are not eligible or authorized to be bound by this agreement, you must not access or use the Service. Continued use of the Service will be considered acceptance of these terms and any future updates or modifications.

Miloji Live Service

These Terms of Service apply to all users of the Miloji Live Service. Miloji Live provided status information may contain links to third party websites that are not owned or controlled by Miloji Live. Miloji Live has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites. In addition, Miloji Live will not and cannot censor or edit the content of any third-party site. By using the Service, you expressly acknowledge and agree that Miloji Live shall not be responsible for any damages, claims or other liability arising from or related to your use of any third-party website.

Miloji Live Access

Subject to your compliance with these Terms of Service, Miloji Live hereby grants you permission to use the Service, provided that: (1) your use of the Service as permitted is solely for your personal, noncommercial use; (2) you will not duplicate, transfer, give access to, copy or distribute any part of the Service in any medium without Miloji Live's prior written authorization; (3) you will not attempt to reverse engineer, alter or modify any part of the Service; and (4) you will otherwise comply with the terms and conditions of these Terms of Service.

Prohibited Activities

When using Miloji Live, you agree to use the Service responsibly and in full compliance with all applicable laws and these Terms of Service. You must not engage in any of the following prohibited activities:

Using the Service for any unlawful, harmful, fraudulent, or malicious purpose.

Harassing, threatening, abusing, defaming, or impersonating other users.

Sharing, posting, or transmitting any content that is obscene, sexually explicit, violent, discriminatory, or otherwise offensive.

Engaging in child exploitation, including the creation, distribution, or solicitation of any content involving minors.

Attempting to access or interfere with other users’ accounts or data without authorization.

Uploading viruses, malware, or any other harmful code intended to damage or disrupt the Service or other users’ devices.

Using automated systems such as bots or scrapers without our prior written consent.

Violating the intellectual property rights or privacy rights of others.

Circumventing, disabling, or interfering with security-related features of the Service.

We reserve the right to investigate and take appropriate legal action against anyone who violates these rules, including suspending or terminating accounts and reporting illegal activity to law enforcement.

Zero Tolerance for Child Sexual Abuse and Exploitation (CSAE)

Miloji Live maintains a strict zero-tolerance policy toward any form of child sexual abuse and exploitation (CSAE). This includes, but is not limited to, the creation, possession, distribution, solicitation, or sharing of any content involving the sexual abuse or exploitation of minors.

Users are strictly prohibited from using the Service to engage in or facilitate CSAE-related activities. Any attempt to exploit, harm, or endanger minors through the platform will result in immediate account termination and will be reported to the appropriate law enforcement authorities, including organizations such as the National Center for Missing & Exploited Children (NCMEC), in accordance with applicable laws.

We actively monitor, detect, and report content or behavior that may suggest CSAE, using both automated tools and manual review. We also cooperate fully with law enforcement and child protection agencies to support investigations and ensure the safety of minors.

Paid Services

Miloji Live may offer optional paid features or virtual goods that can be purchased through in-app transactions. These in-app purchases provide access to additional functionality or enhanced user experiences. All purchases are processed securely through third-party platforms such as the Apple App Store or Google Play Store. We do not store your credit card or payment information directly. Please note that all sales are final, and we do not provide refunds unless required by applicable law or the policies of the app store through which the purchase was made.

By making a purchase, you agree to pay the listed price and abide by any additional terms presented during the transaction process. If you have questions or concerns about a charge, please contact the respective app store or reach out to our support team for assistance.

Intellectual Property Rights

The design of the Miloji Live Service along with all text, scripts, graphics (including stickers), interactive features and the like made available in connection with the Miloji Live Service (collectively, the "Miloji Live Client and Content"), except all User Status Submissions (as defined below), and the trademarks, service marks and logos contained therein ("Marks"), are owned by or licensed to Miloji Live, subject to copyright and other intellectual property rights under laws and international conventions. Subject to these Terms of Service, you are granted a personal, non-exclusive, non-transferable, revocable, limited license to install and use, only in connection with the Service, the Miloji Live Client and Content for personal and non-commercial purposes only. The Service, including the Miloji Live Client and Content, is provided to you as is for your information and personal non-commercial use only. Miloji Live reserves all rights not expressly granted in and to the Service and the Miloji Live Client and Content. You agree to not engage in the use, copying, distribution or other exploitation of any of the Miloji Live Client and Content other than expressly permitted herein, including any use, copying, or distribution of User Status Submissions of third parties obtained through the Service for any commercial purposes. You further agree not to use the Miloji Live Client and Content in a manner that would infringe or violate the rights of any third party and that we are not in any way responsible for any such use by you.

Limitation of Liability

IN NO EVENT SHALL Miloji Live, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY (1) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (2) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR SERVICE, (3) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR SERVERS, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH OUR SERVICE BY ANY THIRD PARTY, AND/OR (V) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE Miloji Live CLIENT AND CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE COMPANY IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION. YOU SPECIFICALLY ACKNOWLEDGE THAT Miloji Live SHALL NOT BE LIABLE FOR USER SUBMISSIONS OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU.

Indemnity

You agree to defend, indemnify and hold harmless Miloji Live, its parent corporation, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Miloji Live Service; (ii) your violation of any term of these Terms of Service; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that one of your User Status Submissions caused damage to a third party. This defense and indemnification obligation will survive these Terms of Service and your use of the Miloji Live Service.

Assignment

You may not assign, delegate, or otherwise transfer your rights or obligations under these Terms of Service, whether by operation of law or otherwise, without the prior written consent of Miloji Live. Any attempt by you to assign or transfer these Terms without such consent will be null and of no effect.

Miloji Live, on the other hand, may freely assign or transfer these Terms of Service, in whole or in part, without restriction and without notice to you. This includes, but is not limited to, assignments in connection with a merger, acquisition, sale of assets, corporate restructuring, or by operation of law.

Copyright Complaints

Miloji Live respects the intellectual property of others, and we ask our users to do the same. If you believe that your work has been copied in a way that constitutes copyright infringement, or that your intellectual property rights have been otherwise violated, you should notify Miloji Live of your infringement claim in accordance with the procedure set forth below.

Miloji Live will process and investigate notices of alleged infringement and will take appropriate actions under the Digital Millennium Copyright Act ("DMCA") and other applicable intellectual property laws with respect to any alleged or actual infringement.

To be effective, the notification must be in writing and contain the following information: an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest; a description of the copyrighted work or other intellectual property that you claim has been infringed; a description of where the material that you claim is infringing is located on the Miloji Live Service, with enough detail that we may find it on the Miloji Live Service; your address, telephone number, and email address; a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright or intellectual property owner, its agent, or the law; and a statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner's behalf. If you believe that your content that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to upload and use the content in your content, you may send a written counter-notice containing the following information to the Copyright Agent: your physical or electronic signature; identification of the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or disabled; a statement that you have a good faith belief that the content was removed or disabled as a result of mistake or a misidentification of the content; and your name, address, telephone number, and email address, a statement that you consent to the jurisdiction of the competent court located within BVI and a statement that you will accept service of process from the person who provided notification of the alleged infringement.
